1. Acceptance

By accessing and using Toolkiya ("toolkiya.com"), you agree to these Terms of Service. If you do not agree, please do not use the website.

2. Service Description

Toolkiya provides free online tools for file processing, image editing, document generation, and other utilities. All processing happens in your browser — we do not upload, store, or access your files.

3. User Responsibility

You are solely responsible for how you use the tools and any documents or files generated, transmitted, or processed through this website. You agree to use the tools only for lawful purposes and in compliance with all applicable laws, including (for users in or connecting from India) the Information Technology Act 2000, the Copyright Act 1957, the Bharatiya Nyaya Sanhita 2023, and the Digital Personal Data Protection Act 2023.

You must not use these tools to create, share, or receive fraudulent, misleading, or illegal content. You confirm that you are at least 18 years old, or using the service with the supervision and consent of a parent or legal guardian. Any misuse of the tools is your responsibility and Toolkiya shall not be held liable. Our full rules are published in our Acceptable Use Policy, which forms part of these Terms.

3a. Peer-to-Peer Tools (Send, Clipboard, Webcam, Scanner)

Toolkiya offers peer-to-peer tools that establish a direct, encrypted WebRTC connection between two end-user devices. The content you send through these tools (files, text, video, audio, images) does not pass through Toolkiya servers. Toolkiya acts as a pure conduit, limited to:

• Generating short-lived pairing codes (5-minute TTL)
• Issuing rate-limited STUN/TURN credentials
• Relaying signaling messages (offer/answer/ICE) via Supabase Realtime broadcasts, which are not persisted

Because we cannot inspect or moderate peer-to-peer content in real time, you are fully responsible for what you transmit. By using these tools, you confirm that you have the legal right to share the content and that it does not violate this Agreement, our Acceptable Use Policy, or the laws of your jurisdiction. Toolkiya reserves the right to revoke pairing codes, block IP addresses, and cooperate with lawful authorities in response to abuse reports.

3b. No-Signup Service & Safe Harbor

Toolkiya does not require registration or user accounts. All tools are made available anonymously to anyone with a web browser. Toolkiya operates as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000 and relies on the safe-harbor provisions of Section 79 of that Act, read with Rule 3 of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, and on equivalent provisions in other jurisdictions including 17 U.S.C. § 512 (DMCA).

As a passive conduit, Toolkiya does not initiate the transmission, select the recipient, or modify the content of any peer-to-peer session. We exercise due diligence through published policies, rate-limiting, abuse reporting, a designated Grievance Officer (see Grievance Redressal), and prompt response to lawful notices.

4. Disclaimer

All tools are provided "as is" without warranties of any kind. Toolkiya does not guarantee the accuracy, completeness, or suitability of any output generated by the tools. Documents generated are templates for reference purposes — users should verify correctness before use.

Toolkiya is not affiliated with, endorsed by, or connected to any third-party company, brand, or service mentioned on this website. All trademarks and brand names belong to their respective owners and are used only for identification purposes.

5. Limitation of Liability

Toolkiya shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the tools, including but not limited to damages for loss of data, profits, or business opportunities.

6. Intellectual Property

The Toolkiya name, logo, and website design are the property of Toolkiya. You may not copy, reproduce, or distribute any part of the website without permission. Files you process through the tools remain your property — we claim no ownership over your content.

7. Third-Party Services

We use Google Analytics for anonymized usage data and Google AdSense for advertisements. These services have their own privacy policies and terms. We are not responsible for third-party service behavior.

8. Changes

We may update these terms at any time. Continued use of the website after changes constitutes acceptance of the new terms.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of India. For users outside India, continued use of Toolkiya constitutes consent to the exclusive jurisdiction of courts designated by Toolkiya in India.
